Sometime late Friday evening news broke that talks appeasement with Iran over their nuclear program broke down and will be extended out to November under the initial agreement made. In other words, Iran bought time and as we reported last week, time is not on our side when it comes to the Islamic totalitarian theocratic regime of the mad mullahs and ayatollahs. Iran is the worlds number one state sponsor of Islamic terrorism Im quite sure you will find Irans fingerprints all over Gaza and support for Hamas.

So to add insult to injury we have this report from Adam Kredo at the Washington Free Beacon saying, The United States will give Iran access to another $2.8 billion over the next several months and appears to have conceded to Irans demand that it be permitted to domestically enrich uranium, the key component in a nuclear weapon.

And in case you missed it, Obama decided to extend talks past the July 20 deadline. Dont expect anything to happen until after the November midterm elections. How convenient.

According to Kredos report, the United States already returned to Iran $4.2 billion in unfrozen oil assets during the past six months of the interim nuclear deal. So in essence that which was best affecting Iran hardline economic sanctions is being relaxed while Iran proceeds .. . . . . . . .

This morning the U.S. Court of Appeals for the D.C. Circuit released its much awaited opinion in Halbig v. Burwell. In a 2-1 opinion, the Court held that the Internal Revenue Service regulation authorizing tax credits in federal exchanges was invalid. Judge Griffith, writing for the court, concluded, the ACA unambiguously restricts the section 36B subsidy to insurance purchased on Exchanges established by the State. In other words, the court reaffirmed the principle that the law is what Congress enacts the text of the statute itself and not the unexpressed intentions or hopes of legislators or a bills proponents. Judge Randolph joined Judge Griffiths opinion and wrote a concurrence. Judge Edwards dissented. The opinions are available here.

Here is the introduction to Judge Griffiths opinion:

Section 36B of the Internal Revenue Code, enacted as part of the Patient Protection and Affordable Care Act (ACA or the Act), makes tax credits available as a form of subsidy to individuals who purchase health insurance through marketplacesknown as American
Health Benefit Exchanges, or Exchanges for shortthat are established by the State under section 1311 of the Act. 26 U.S.C. 36B(c)(2)(A)(i). On its face, this provision authorizes tax credits for insurance purchased on an Exchange established by one of the fifty states or the .. . . . . . . .

White House spokesman Josh Earnest told reporters on Monday that the situation at the overwhelmed Texas-Mexico border is improving, and he attributed it partly to the administrations response:

You know, we have seen a reduction, at least for now, in the flow of individuals from these Central American countries to the border. Weve seen a stepped-up campaign from Customs and Border Patrol in Spanish-language media, in Central America, to try to make it clear why parents should not put their kids on this dangerous journey.

Earnest said the reasons for the reduced numbers of unaccompanied children and adults traveling with children cannot be attributed to any one factor.

In a potentially crippling blow to Obamacare, a federal appeals court panel declared Tuesday that government subsidies worth billions of dollars that helped 4.7 million people buy insurance on HealthCare.gov are illegal.

A judicial panel in a 2-1 ruling said such subsidies can be granted only to those people who bought insurance in an Obamacare exchange run by an individual state or the District of Columbia not on the federally run exchange HealthCare.gov.

"Section 36B plainly makes subsidies available in the Exchanges established by states," wrote Senior Circuit Judge Raymond Randolph in his majority opinion, where he was joined by Judge Thomas Griffith. "We reach this conclusion, frankly, with reluctance. At least until states that wish to can set up their own Exchanges, our ruling will likely have significant consequences both for millions of individuals receiving tax credits through federal Exchanges and for health insurance markets more broadly."

Obamas LGBT Executive Order Threatens Religious Liberty, Say Advocates

Unwilling to wait for Congress to pass the Employee Non-Discrimination Act, Obama signed an executive order Monday prohibiting organizations with federal contracts from discriminating against employees who identify themselves as gay, lesbian, or transgender.

For religious freedom advocates, that could pose a major problem. Obamas order does not provide an exemption for religious organizations, whereas the ENDA bill before Congress does.

Carmen Fowler LaBerge president of the Presbyterian Layman Committee set aside her ordination in the Presbyterian Church U.S.A. after the General Assembly opened the door for gays and lesbians to be ordained as ministers in 2010. LaBerge, who defines herself as pro-traditional marriage, believes Obamas executive order for LGBT non-discrimination will actually discriminate against religious organizations with federal contracts.
